If you use our website hosting services, you are responsible for the content published on your hosted website. You agree that your hosted website content will not violate any applicable laws, infringe on third-party rights, or contain harmful or misleading information. We reserve the right to suspend or terminate hosting services for websites that violate these Terms.
Our EGTW Alerts program provides operational and transactional notifications to hosted website owners. By opting into SMS alerts, you agree to the SMS/Messaging Terms and our Privacy Policy. You may opt out of SMS alerts at any time by replying STOP to any message.
Fees for our services are outlined in individual service agreements or proposals. Payment terms, including due dates and accepted methods, will be specified in the applicable agreement. Late payments may result in suspension of services.
To the fullest extent permitted by law, Evergreen Techworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.
You agree to indemnify and hold harmless Evergreen Techworks, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or your violation of these Terms.
We may suspend or terminate your access to our services at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use our services will immediately cease. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.
